bellingham rainy days

AH Bellingham rainy days.. now we finally begin the winter season. my poor ramp though is getting ruined!

haven't posted in a while, there've just been a lot of life struggles going on.

feel free to spare yourself this description of woes:

found out the extra cutco job was crap before ever beginning. FINALLY got the landmark thing sorted out using half of this months phone minutes. got pulled over for expired tabs, and had let insurance lapse too (again!). talked the cop into a warning ticket. got insurance and registration the same day ($150 instead of $800). the clutch and brake pedals in the truck have been progressively breaking and flopping around since i bought it a few years ago, finally making it undrivable last week. paid a hundred bucks for the pedal-assembly, put it in with davey's help. but behind the pedal assembly between the brake master cylinder is an also broken brake-booster tied in to the vacuum system that we did not discover until put back together. REDO. just got back from shop for $310 that i had to use from this months rent money. GREAT. my vacuum broke today too.
my 500G external hard drive has crashed taking all of my footage, music (except for what's on my ipod), multi hundred gig movie collection and most sadly all those things i don't even know i've lost with it. it's a physical failure, can hear the drive spin erratically so the only real option is to (of course) buy a new one of greater size, and attempt a data recovery transfer project. BLEGH!!

got a second job at domino's to help cover this all, and try to stay up. far better than being mired in sadness. will start next wed "rush" if my truck keeps working.

since i can finally skate again, that has once more become my release for the stress and frustration. even though i'm an achy old man nowdays.
have been working my BUTT of learning proper flip tricks that POP, AND doing them all switch too. will make a quick vid of my progress soon! a little silly to be skating inside on the linoleum in a tiny space because it's raining, but still can practice proper technique.

so yeah... been a little overwhelming in ways with one thing after another and the steady overall feeling of always WANTING to MOVE forward with some bigger projects already. lots of sweet options waiting for someone to DO them. lol

*
the personal mental challenge encountered when engaged in open technical learning while getting over fear of pain and failure, coupled with the physical state reached during the extremely demanding effort involved blending all into "flow," have the power of complete removal from the usually understood "world," instead providing insertion into a sort of impulsive all-or-none timeless "NOW moment" whose experience powerfully affects the psyche.

or something..

Landmark Property Management Resolution Letter

so here it is. the 2310 Sunset house Landmark Resolution Letter I demanded this time in order to have proof.

this whole incident still has an incredibly slimy feel to it. i'd rather not wallow in the numerous scandalous tactics they attempted by listing them now that it's all done.
will just say PHEW!

$2,000 Ashley Landmark LIE SCAM

as mentioned in previous posts, Landmark Property Management attempted to scam us for over $2,000 in unreasonable charges and repairs over a year after we moved out. ridiculous charges including $1,000 for completely replacing carpet that was NOT our responsibility and over $600 more in repainting the house!
OVER A YEAR AFTER WE MOVED OUT.
despite marking us cleared on the move-out checklist walk-through done together.
they would not respond for weeks post move out to our numerous calls and voice-mails in which we left our new contact information in order to sort out the return of our deposit we expected as the house was in better condition when leaving than upon move in.

BUT Ashley Henkins from Landmark appeared to acquiesce when i contacted her by phone. she "looked into it," then explicitly assured me it was a computer mistake from a "system changeover" that we would not be liable for because it had been "zeroed out" somehow.
i thanked her for her understanding and promised to spread word about how the situation was handled justly and professionally. as i began to do.

NOW THE $2,000 HAS BEEN SENT TO COLLECTIONS! and landmark suggests we work it out with the collections agency!! WHAT????!!!!!!
AHHHHHHHHHHHHHHHHHHHHHH!
THIS HAS TO BE ILLEGAL.

i'm absolutely floored at the BOLD FACED EXTREMELY PROFICIENT LYING that left me complacent. i failed to demand paperwork proving her reasonable ascertains. i was convinced that they had no basis backing the charges or the defunct timing and she convinced me that she agreed and had taken steps while i was on hold to remedy the situation.

so now unfortunately i believe one roommate, nate has already begun contacting lawyers and arbitrators to get a feel for our legal recourse. we're rounding up paperwork and video evidence. there is NO CHANCE we'll take this lying down quietly. if you consider the amount spent on advertising, this is going to be a costly $2,000 scam if indeed that's what is now happening.
i can only hope these are further "computer errors" caused by the "computer error" that generated outrageous charges now further wasting my time, energy and money.

thank you so much Landmark, and Bridget (the original "nice-cool seeming" "property manager") and Ashley the current "nice-cool seeming" "property manager."

i've done this before, and removed it before anyone noticed. but decided to leave it, whatever already there, and then post a better "Practice Min 2" effort when i've chopped it down.

about a week ago i posted a rant about the $2,000 move-out bill we'd received from landmark over a year after we'd moved out, explaining the situation and arguing that they had no legal or even moral right to do this.
to my AMAZEMENT, upon calling this morning braced for a battle i was instead met with listening, understanding, some research and the charges were dropped!
WELL. my rant has become a rave of RELIEF.
thank you A*****(i don't want to give out personal info). you seemed to realize that landmark will most likely make more money by spreading a good reputation across whatcom than they ever could through shady tactics of charging good renters.
wanted to share this positive conclusion. and tell the people who sent support emails thank you as well! might not have felt like i had a legitimate argument without the reinforcement.
another quick note for would be renters out there - we did our walkthrus on video. i think this is an easy, powerful way to protect ourselves. consider the camera $2,000 could afford! not like i had it anyways

Landmark Scammers! (bellingham)
Date: 2009-09-04, 7:46PM PDT

Holy crap! I just got a letter today, postmarked this week, from Landmark Property Management regarding a tenancy we moved out of over a year ago claiming that we owe $2,000 dollars in move out costs! demanding payment within a week or threatening referral to collections.
This is outrageous for countless reasons! AHH!
To start, the house was filthy when we moved in and cleaned up when we left. We did our walk-through on video showing the sorry (standard yearly-rented beat down bellingham college house) state because we were taking over a broken lease from some losers who couldn't keep up on rent. I have this video. Then were told it looked good on move out, when asked specifically were told that we weren't responsible for normal wear and tear beyond the non-refundable $100 or so portion of the deposit. I'd even gotten a new Pet-Hair vacuum right before moving out which got all the carpets really clean, though of course not brand new again.
Someone has been living there for the past year.
NOW they are trying to charge me $1,000 over a YEAR later for replacing the old carpet that is completely their responsibility.
And fault realistically if they're saying it needs to be replaced because Landmark had neglected to repair a continually worsening hole in the roof over the living room, which ruined one of our xbox360s the first time it leaked through into the house and was noticed. Our loss i guess, we're chill people and called it an unfortunate accident that just sucks. We repeatedly called requesting the hole be repaired, water was getting into the insulation, walls and floor. This went on for over a month in rainy Bellingham until finally we called furiously telling them was a garbage bucket set in our living room that was filling with water and would get pictures. When they finally did "fix" it, they just left all the moldy rot inside, and slapped a new roof on top (i assume using the owners money) with a sunlight where the hole used to be. Super. For the next renters, owners, us, but especially for their profit.
NOW they're trying to take advantage of ME and screw me over for completely NEW carpet? The list goes on.. damn, i can't type it all.
I attempted to contact Landmark over a dozen times the first few weeks after we turned in keys and did our walk-thru in order to collect some of our deposit that i hoped might remain as we left the place in good shape. Was repeatedly calling, leaving phone numbers for myself and the two other roommates as well as new addresses we were all moving away to (which is the way they are NOW contacting me) asking for information. I could never get past leaving messages.
Life is busy, and i'd heard that there was a 90 (or 14) day policy requiring them to return the deposit. We all moved on and figured time had run out, whatever.
Now in hopes i've lost the paperwork (think i have it, not sure where though) and that they can completely screw over some college kids for $2,000 they're trying to do THIS?
THIS IS A SCAM and i resent it! Isn't there some sort of protection from this treachery for the normal guys?
I'm so furious with this, that house was the last thing on my mind or that i should be dealing with right now. It's been really hard to make it financially lately anyway. Landmark Property Management needs to lose more than they gain for these scams somehow.
Any useful suggestions?
